Tender Terms and Conditions

  1. All Tenders can be in writing or faxed and marked confidential tender.
  2. The successful Tender will be required to pay a buyers premium of 11% (inclusive of gst)
  3. Full payment must be received by Bank Cheque or Telegraphic Transfer only within 5 working days of notification of successful purchase.
  4. Purchasers shall be notified of the outcome.
  5. All offers, deposit and full payments must be made in $ Australian Currency inclusive of gst.
  6. The vendor or agent reserves the right to reject any offer or withdraw any item from the Expressions of Interest.
  7. The highest or any offer will not necessarily be accepted.
  8. Ownership of the equipment and responsibility for the equipment is transferred to the successful purchaser(s) at the time of clear title to full payment of funds.
  9. Whilst the vendor/agent have taken every reasonable precaution to ensure that the goods are adequately described condition remarks and opinions are furnished on the strict understanding that they serve as a guide only.
  10. All lots having been made available for inspection prior to sale, are offered for sale “As is, where is” with all faults (if any) to the full extent permitted by law, and not withstanding the contents of, or any description given in any catalogue, advertising inspection report or any other material issued by the vendor or agents in relation to that lot as
    to its condition, quality, fitness for purpose merchantability or compliance with description.
  11. To the full extent permitted by law, the vendor and or agent will not be liable for any loss, damaged cost or expense suffered or incurred by a purchaser arising out of a sale and purchase of a lot.
  12. Equipment will be available for pickup on receipt of full payment and must be cleared from the premises within 14 days of notification or success of purchase, unless prior arrangements have
    been made with the agent.
  13. Cost & assistance of the removal of tender items will be the responsibility of the successful purchaser(s).
  14. People charged with the responsibility of the removal of items must ensure that all applicable occupational health and safety requirements
    are met.
  15. Neither the vendor or agent shall be responsible for any damage to property or injury to persons incurred during the removal of tender
    items.
  16. Upon the purchaser failing to comply with any of the above conditions any money deposited in part payment shall be absolutely forfeited and all lots uncleared may be resold and the deficiency (if any) on such resale, together with all costs and charges consequent upon such resale shall be made good by the defaulter of this Expressions of Interest.
  17. In addition to the provision of Clause 11 of these conditions, the Auctioneer does not warrant that any electrical or mechanical appliance, plant and/or equipment comply with the requirements of any Federal or State Workplace Health and Safety Acts and Regulations.
  18. Where practical to do so and where the appliance, plant or equipment may be used in a workplace as defined under any Workplace Health and Safety Act, the Auctioneer has requested the Vendor to display a statement with the various appliances, plant and equipment to indicate their present condition.
  19. The Vendor has also been requested to supply certificates, operation manual, etc. which may exist for the particular appliance, plant or piece of equipment.
  20. The purchasers shall be responsible to ensure that the appliance plant or equipment complies with the requirements of Workplace Health and Safety Acts before it is used in the workplace or for domestic use.
